Neil Best Photography provides online photography galleries, including sports, rugby, wildlife, landscape and event photography. Selected images may be available to purchase as prints, framed products, other photographic products or digital downloads.

2. Use of This Website

You may use this website for personal, non-commercial purposes, including:

Viewing photography galleries
Sharing links to galleries or images
Purchasing prints or digital downloads where available
Contacting Neil Best Photography about images, orders or permissions

You must not:

Copy, download, screenshot, reproduce or distribute images without permission

3. Copyright and Image Ownership

All photographs, images, text and other creative content on this website are owned by Neil Best Photography, unless otherwise stated.

Buying a print, framed product or digital download does not transfer copyright ownership to you.

Unless expressly agreed in writing, purchased images are for personal use only. You may not:

Sell or licence the image
Use the image for advertising or promotion
Submit the image to publications, sponsors or media outlets
Edit, alter or manipulate the image for public or commercial use
Use the image on merchandise or printed products for resale

4. Sports and Event Photography

Many images on this website are taken at public sporting events, including rugby matches.

Images may include players, coaches, officials, spectators, parents, staff and volunteers. These images are published for sporting, editorial, artistic, archival and photographic purposes.

If you believe an image of you or your child has been published inappropriately, or you would like an image reviewed or removed, please contact:

Reasonable requests will be considered promptly, particularly where children, vulnerable persons, safeguarding concerns or sensitive circumstances may be involved.

5. Orders

Orders may be placed through this website or through a third-party platform such as Pixieset.

When you place an order, you are responsible for ensuring that:

The selected image is correct
The product type, size and finish are correct
Delivery details are accurate
Any spelling, naming or personalisation details are correct
You have authority to use the payment method provided

An order is not accepted until payment has been successfully processed and an order confirmation has been issued.

We reserve the right to cancel or refuse an order if:

The image is no longer available
There has been a pricing or product error
The order appears fraudulent or unauthorised
The product cannot be fulfilled by the print lab or supplier
There is a legal, safeguarding or ethical reason not to supply the image

If an order is cancelled after payment has been taken, you will receive a refund where appropriate.

6. Pricing and Payment

Prices are shown on the website at the time of ordering.

Prices may change from time to time, but changes will not affect orders already accepted.

Payment is usually processed by secure third-party providers through Pixieset or another payment platform. Neil Best Photography does not normally receive or store your full card details.

You are responsible for any additional costs clearly shown at checkout, such as:

Delivery charges
Taxes or duties where applicable
Optional product upgrades
Framing or finishing costs

7. Print Fulfilment and Third-Party Suppliers

Prints, framed products and other physical items may be produced and delivered by third-party professional print laboratories or fulfilment partners.

By placing an order, you understand that certain parts of the order process may be handled by third parties, including:

Payment processing
Print production
Framing or finishing
Packaging
Delivery

Neil Best Photography will take reasonable care when choosing suppliers, but production and delivery times may depend on the relevant third-party provider.

8. Delivery

Estimated delivery times may be shown at checkout or provided after ordering.

Delivery times are estimates only and may vary depending on:

Product type
Print lab workload
Framing or finishing requirements
Courier or postal delays
Seasonal demand
Incorrect or incomplete delivery information

Please check your delivery address carefully before submitting your order.

Neil Best Photography is not responsible for delays caused by incorrect delivery information provided by the customer.

9. Digital Downloads

Where digital downloads are offered, they are supplied for personal use only unless otherwise agreed in writing.

You may use personal digital downloads for:

Personal viewing
Personal printing
Sharing with family or friends
Personal social media use, provided the image is not altered and credit is given where reasonably possible

You may not use digital downloads for:

Commercial marketing
Club promotion
Sponsor advertising
Media publication
Product resale
Merchandise
AI training datasets
Any unlawful or harmful purpose

Once a digital download has been supplied, cancellation rights may be limited if you agreed to receive the download immediately. Consumers buying online may have cancellation rights, but digital content can be treated differently where immediate access is requested.

10. Cancellations, Returns and Refunds

Please contact neil@neilbest.photography as soon as possible if you need to cancel or amend an order.

Because many photographic products are produced specifically to order, cancellation or refund rights may depend on whether production has already started and whether the item is personalised, custom-made or faulty.

Under UK consumer rules, online shoppers often have cancellation rights, but there are exceptions, including for goods made to a customer’s specification or clearly personalised.

10.1 Custom or Made-to-Order Products

Prints, framed prints, canvases and other products produced specifically from your selected image may be treated as made-to-order items.

Where production has started, cancellation may not always be possible unless the item is faulty, damaged or not as described.

10.2 Faulty or Damaged Items

If your order arrives damaged, faulty or materially different from the product description, please contact us as soon as possible and include:

Your order number
A description of the issue
Photographs of the damaged item and packaging
Your preferred resolution

Where appropriate, we may arrange a replacement, refund or other remedy.

10.3 Change of Mind

If you simply change your mind, please contact us promptly. We will confirm whether cancellation or return is possible for your particular order.

Any cancellation charges or retained amounts must be fair and reasonable under UK consumer law.

11. Image Colour, Cropping and Print Appearance

Every effort is made to display images accurately. However, printed products may vary slightly from what appears on screen due to:

Monitor brightness and colour settings
Print papers and finishes
Cropping for different print sizes
Framing or mount options
Image aspect ratio

Some print sizes may require cropping. Please check the preview carefully before placing your order.

12. Watermarks

Images displayed online may include watermarks or reduced-resolution previews.

Purchased prints and authorised downloads will normally be supplied without website preview watermarks unless otherwise stated.

Removing or attempting to remove watermarks from website preview images is not permitted.

13. Personal Use and Sharing

You may share links to public galleries.

You may not copy or repost website preview images without permission.

If you purchase a digital image and share it on social media, please credit Neil Best Photography where reasonably possible.

14. Club, Team, Media and Commercial Use

If you are a rugby club, sports team, sponsor, publication, business or organisation and wish to use images for promotional or commercial purposes, you must obtain written permission first.

Commercial use may include, but is not limited to:

Social media marketing by clubs or sponsors
Website banners
Match programmes
Posters
Advertising
News or editorial publication
Player sponsorship graphics
Merchandise
Fundraising campaigns

Additional licence fees may apply.

15. Accuracy of Information

We aim to keep website information accurate and up to date, but we do not guarantee that all content, product details, prices or availability will always be error-free.

If an error is discovered after you place an order, we will contact you as soon as reasonably possible.

We aim to keep the website available and working properly, but we do not guarantee uninterrupted access.

The website may be unavailable from time to time due to:

If you are a parent, guardian, player, club official or safeguarding officer and have concerns about a particular image, please contact us promptly.

We may remove, restrict or amend access to images where we consider it appropriate.

19. Limitation of Liability

Nothing in these Terms limits or excludes liability where it would be unlawful to do so.

Subject to that, Neil Best Photography is not responsible for:

Indirect or consequential losses
Loss of profit or business opportunity
Delays outside our reasonable control
Customer errors when placing orders
Unauthorised use of images by third parties
Differences between screen display and final printed output

Our responsibility for any order will normally be limited to the amount paid for that order, unless the law requires otherwise.
